Terms of Service

1. Acceptance of terms

By accessing or using ArtistHQ ("the platform", "the service"), operated at artisthq.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the platform.

2. Description of service

ArtistHQ is a band and artist management platform that provides tools for managing shows, finances, merchandise, releases, contacts, crew, gear, tasks, documents, and calendars. We offer free and paid subscription tiers.

3. Account registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to use the platform.
• One person or organization may maintain multiple artist workspaces, but each workspace must represent a genuine artist or band project.
• You are responsible for all activity that occurs under your account.
• If you create a workspace on behalf of a band or organization, you represent that you have the authority to bind that entity to these terms.

4. Your data

You retain full ownership of all data you enter into ArtistHQ, including but not limited to show information, financial records, contacts, documents, and creative works. We do not claim any intellectual property rights over your content.

You represent and warrant that you own or have the necessary licenses, rights, and permissions to upload and use all data and content you submit to the platform.

You grant us a limited license to store, process, and display your data solely for the purpose of providing the service to you. This license ends when you delete your account or data.

5. Acceptable use

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other users' accounts or data.
• Upload malicious code, viruses, or any harmful content.
• Upload copyrighted material, trademarks, or other intellectual property without proper authorization from the rights holder.
• Use the platform to send spam or unsolicited communications.
• Use the platform to facilitate the sale or tracking of illegal or prohibited merchandise.
• Resell, sublicense, or redistribute access to the platform without our written consent.
• Scrape, crawl, or use automated tools to extract data from the platform beyond what is provided through our export features.

6. Copyright and takedown

ArtistHQ respects intellectual property rights. If you believe that content hosted on our platform infringes your copyright, you may submit a takedown notice to our designated copyright agent at copyright@artisthq.app.

Your notice must include:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the infringing material and its location on the platform.
• Your contact information (name, email, and mailing address).
• A statement that you have a good-faith belief that use of the material is not authorized.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Upon receiving a valid notice, we will promptly remove or disable access to the infringing material and notify the user who uploaded it. Users may submit a counter-notice if they believe the takedown was made in error.

7. Subscription and billing

ArtistHQ offers subscription plans. Current pricing and plan details are available on our website. Paid subscriptions are billed monthly or annually. You may cancel at any time, and your subscription will remain active until the end of the current billing period. We do not provide refunds for partial billing periods.

EU/UK users: Under consumer protection law, you have a 14-day right of withdrawal from the date of purchase. However, by accessing paid features immediately upon subscribing, you explicitly consent to the digital content being provided before the withdrawal period ends and acknowledge that this waives your right to cancel for a refund.

8. Service availability

We strive to maintain high availability but do not guarantee uninterrupted access to the platform. We may perform scheduled maintenance, and the service may occasionally be unavailable due to factors beyond our control. We are not liable for any loss or damage resulting from service interruptions.

9. Data export and portability

You may export your data at any time using the built-in CSV export features available across all modules. Upon account deletion, we will provide a reasonable window to export your data before it is permanently removed.

10. Account termination

• You may delete your account at any time from the settings page.
• We may suspend or terminate your account if you violate these terms.
• Upon termination, your data will be deleted within 30 days, except where we are required to retain it by law.

11. Limitation of liability

Nothing in these terms shall limit or exclude our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to the above, and to the maximum extent permitted by law, ArtistHQ and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the platform.

Our total liability for any claims related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of warranties

Except as required by applicable consumer protection laws that cannot be legally excluded (including the Australian Consumer Law and EU/UK statutory consumer guarantees), the platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be error-free or that any defects will be corrected.

13. Indemnification

You agree to indemnify and hold harmless ArtistHQ and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform or your violation of these terms.

14. Changes to these terms

We may update these terms from time to time. We will give at least 30 days' notice before material changes take effect, by posting a notice on our website or sending you an email. Your continued use of the platform after the notice period constitutes acceptance of the updated terms.

15. Governing law

These terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles. The courts of Sweden shall have exclusive jurisdiction over any disputes arising from these terms or your use of the platform.

Nothing in this section limits your rights under mandatory consumer protection laws in your country of residence, where such laws cannot be contractually overridden.

Before pursuing formal legal proceedings, both parties agree to attempt to resolve any disputes through good-faith negotiation.
